1. About these terms
1.1 SIMFX provides this site to deliver its own training.
1.2 By signing in, you accept these terms. The Privacy Policy explains how your personal data is used.
2. Signing in
2.1 You sign in with a single-use link sent to your email address. The link is for the person it was sent to and shall not be forwarded.
2.2 Anyone who can read your email can sign in as you. You shall keep your email account secure.
2.3 An enrolment code shall be used only as SIMFX directs.
2.4 Administrators shall keep their password and two-factor device secure, and shall not share an administrator account.
3. Acceptable use
3.1 You shall not:
- try to reach data or parts of the site that your role does not give you;
- interfere with the site's security, its records or its audit log;
- upload a course or document that contains malicious code, or that you have no right to use;
- use automated tools to copy content from the site or to overload it;
- share course content outside SIMFX's training without permission;
- send messages through the site about anything other than training.
3.2 SIMFX or SIMFX may suspend an account that breaks these terms.
4. Training content
4.1 Courses provide training and awareness. They are not legal, compliance or professional advice.
4.2 Completing a course does not by itself make you or SIMFX compliant with any law, regulation or regulator's requirement.
4.3 SIMFX decides what training its people need and is responsible for meeting its own legal and regulatory obligations.
4.4 Guidance changes, and a general course cannot account for every workplace. SIMFX shall confirm that a course is current and adequate before relying on it.
5. Records and certificates
5.1 The site records your progress and completion. When you meet a course's completion requirements, it issues a certificate with a unique serial number.
5.2 An altered certificate is not valid. Its serial number does not match the site's record.
5.3 Where a certificate and the site's record differ, the site's record applies.
6. Availability
6.1 SIMFX provides the site as it is and does not guarantee uninterrupted or error-free operation.
6.2 The site changes as it is improved.
7. Intellectual property
7.1 SIMFX owns the platform, its design and its software.
7.2 The rights in each course belong to its author. You may use a course for your own training on this site only.
7.3 SIMFX® is a registered trademark of SIMFX LTD. Airbrain and Airbrain LMS are brands of SIMFX LTD. Nothing in these terms grants a licence to use them.
8. Liability
8.1 Nothing in these terms excludes or limits liability where the law does not allow it. This includes liability for death or personal injury caused by negligence, and liability for fraud.
8.2 Subject to clause 8.1, SIMFX is not liable for the legal or regulatory compliance of SIMFX or its people. SIMFX is not liable for any decision taken on the basis of a course or a record. SIMFX is not liable for indirect or consequential loss.
8.3 SIMFX's total liability is limited as set out in its agreement with SIMFX. Where no agreement applies, it is limited to the amount paid to SIMFX for the site in the twelve months before the claim.
9. Data protection and complaints
9.1 The Privacy Policy explains how to complain about the handling of your personal data.
9.2 Other complaints about the site go to SIMFX using the details in Section 12.
10. Changes to these terms
10.1 These terms may be updated. The date at the top of the page shows when they last changed. Using the site after a change means you accept the updated terms.
11. Governing law
11.1 These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
